Exigency Case Decision – remanded back to PRC

06/05/2015

2015/06/05 United States Court of Appeals for the district of Columbia Circuit Court has remanded the case back to PRC.

“We grant the Postal Service’s petition for review in part, vacate the “count once” portion of the Commission’s order, and otherwise deny the petition. We also deny the Mailers’ petition for review. The case is remanded for proceedings consistent with this opinion.”

What does this for mailers?

  • The exigency rate will likely not be rolled back in August
  • The amount and date of when remains in the air
  • The court did however affirmed the PRC’s decision that exigency is NOT permanent
